1. Agreement to Terms

By accessing or using PDF2XRechnung ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

PDF2XRechnung provides an automated invoice conversion service that transforms PDF invoices into XRechnung or ZUGFeRD format e-invoices. The Service includes:

• Automated PDF to XRechnung/ZUGFeRD conversion
• Validation against EN 16931 standards
• Batch processing capabilities (depending on your plan)
• API access (depending on your plan)
• Customer support services

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account and password
• Restricting access to your computer and account
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

4. Acceptable Use Policy

You agree not to use the Service:

• For any unlawful purpose or to violate any laws
• To upload malicious code, viruses, or harmful content
• To infringe on intellectual property rights of others
• To harass, abuse, or harm another person
• To impersonate or misrepresent your affiliation with any person or entity
• To interfere with or disrupt the Service or servers
• To attempt to gain unauthorized access to the Service
• To use the Service for competitive analysis or to build a competing product

5. Payment and Billing

Subscription Plans

We offer various subscription plans. By subscribing to a paid plan, you agree to pay the fees associated with that plan. All fees are:

• Charged in advance on a monthly or annual basis
• Non-refundable except as required by law or expressly stated
• Subject to change with 30 days notice

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will continue to have access to the Service until the end of your paid period.

6. Data Processing and Privacy

By using the Service, you acknowledge and agree that:

• You retain all rights to your uploaded invoice data
• We process your data solely for the purpose of providing the Service
• Uploaded files are automatically deleted within 24 hours
• Our data practices are governed by our Privacy Policy
• You are responsible for ensuring you have the right to upload and convert the invoices

7. Service Availability and Warranties

While we strive to provide reliable service, we do not guarantee uninterrupted or error-free operation. The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

We do not warrant that:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, secure, or error-free
• Converted invoices will be accepted by all recipients or systems
• All errors in the Service will be corrected

8. Accuracy and Limitation of Liability

While we use advanced technology to ensure accurate conversion, you are responsible for reviewing and verifying all converted invoices before sending them to recipients. We recommend checking:

• All amounts, dates, and invoice numbers
• Supplier and customer information
• Tax calculations and line items

In no event shall PDF2XRechnung be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by PDF2XRechnung and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or software without our prior written consent.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to delete your account.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
